Social Media Terms of Use

By posting my story, uploading a picture or testimonial to any website of Lüftner Cruises GmbH (e.g., lueftner-cruises.com) and/or using the #AMADEUSHighlights hashtag, I hereby agree to the following Terms of Use. I hereby confirm that I am 18 years of age or older.

1. USE OF NAME, HANDLE, TEXT, PHOTO, AND LIKENESS

I hereby grant to Lüftner Cruises GmbH, its affiliated companies, and their respective successors and assigns (collectively, the "Permitted Parties") the right and permission to use my name, social media handle, image and likeness, as well as the text and photograph I post to a social media platform such as, but not limited to, Facebook or Instagram, using the #AMADEUSHighlights hashtag (collectively, the "Content") on the websites of Lüftner Cruises GmbH – including, but not limited to, lueftner-cruises.com, lueftner-cruises.com/en, amadeus-flusskreuzfahrten.de, amadeus-rivercruises.com, amadeus-rivercruises.co.uk, amadeus-rivercruises.com.au – and on all official social media channels (Facebook, Instagram, LinkedIn, etc.).
I also grant to the Permitted Parties the right and permission to use Content that I post directly on lueftner-cruises.com.
I agree that the Content may be distributed, published, exhibited, digitized, displayed, reproduced, and otherwise used worldwide, without time limitation, for advertising, marketing, or communication purposes of the Permitted Parties.
I acknowledge that I have no right to compensation, approval, or other claims (including claims for invasion of privacy, defamation, publicity rights, or copyright infringement) arising from the use, editing, adaptation, or combination of the Content, and I irrevocably waive any moral rights in the Content.

2. COMPLIANCE WITH THIRD-PARTY PLATFORM RULES

I acknowledge and agree that when posting Content, I will comply with the applicable terms of use and community guidelines of the platforms I use.

3. TAKEDOWN

If I want my Content removed from the Websites, I will send a message to the following: dataprotection@lueftner-cruises.com.
Removal will occur within a reasonable timeframe after receiving the request.

4. REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION

I represent and warrant as follows:
(a) I have the right to post the Content;
(b) neither the Content nor its use by the Permitted Parties infringes the intellectual property rights or other rights of any third party, including, without limitation, rights of publicity or copyright, or violates applicable law;
(c) the Content does not contain inappropriate, offensive, discriminatory, or illegal material;
(d) the Content does not contain advertising or commercial messages of third parties.

I agree to indemnify and hold the Permitted Parties harmless from any claims, damages, costs, or expenses arising from any breach of these warranties.

5. NO OBLIGATION TO USE

I understand and agree that:
(a) the Permitted Parties are not obligated to use the Content (or any part thereof);
(b) the Permitted Parties may remove the Content at any time at their sole discretion, particularly if deemed inappropriate, obscene, defamatory, or unlawful, or potentially infringing on third-party rights.

6. DISCLAIMER AND LIMITATIONS OF LIABILITY

I agree that:
(a) all disputes related to the Content or these Terms will be resolved individually, without resorting to class actions;
(b) claims are limited to actual out-of-pocket costs, excluding attorney fees;
(c) punitive, incidental, or consequential damages cannot be claimed.

I acknowledge that the Permitted Parties are not liable for damages, losses, or technical errors related to the posting or transmission of Content.

7. GOVERNING LAW AND YOUR RIGHTS

You have the legal rights to information, correction, deletion, restriction, data portability, revocation, and objection.
If you believe that your data is being processed in violation of data protection law or that your rights have been infringed, you may contact the competent data protection authority. In Austria, this is the Datenschutzbehörde (DSB).
